Jay Jacobs speaks ... very briefly.

The athletic director was intercepted as he left the building tonight. He seemed surprised that reporters would spend their time waiting for such an opportunity. I'm surprised that he's surprised.

JACOBS: Tommy and I met this morning. We'll meet again over the next couple of days. I'll let you know how it goes. That's really it.

Are you aiming for resolution this week?

JACOBS: Yes, I'd like to be.

Is it a realistic expectation to think you'll finish it this week?

JACOBS: We'll just have to see.

Are you concerned that the openendedness is hurting the program?

JACOBS: (No verbal response.)

END OF INTERVIEW

if CTT is being fired, he wouldn't settle for less than $6 Million.

How about this (purely speculative) scenario: Tuberville wants to leave and there is another school (MSU?) that wants to hire him but the 6 million dollar buyout is in the way. Could they be negotiating a split between what AU will pay and what (if anything) the school that hires him will pay towards the buyout?

Like I said, that's pure speculation based on absolutely nothing other than looking for an explanation of why this is dragging on. But is it plausible?

I dont think CTT wants to go anywhere. Therefore, AU would have to fire him and pay him the $6million. I think I read that he gets that even if he takes another job afterwards.

The sensible approach to maintaining loyalty to the school is what Oklahoma did with Stoops: instead of including a huge buyout when he renegotiated his deal after the 2004 season, he was promised a $3 million 'loyalty bonus' if he was still HC at OU on 12/31/08.

His 2008 salary, BTW, is slightly less than Tuberville's. His buyout is reportedly $3 million as well.

I wonder if the Athletic Dept. at AU has experienced the same kind of financial windfall that the Sooner AD attributes to Stoops' success?

Cat...

You are correct. Taking another job doesn't reduce the buyout (like it does in Shula's case)...

Whoever negotiated Tuberville's contract from his side is a genius.

9:19 AM
Blogger Romberry said...

Roman if that were the case, why would CTT need to be in those meetings?

Because if Tuberville wants to leave for another job, AU may be in a position to negotiate a lower total buyout with him in order to facilitate the move. That would not be up to the two schools. But again, my scenario is pure speculation based on nothing more than an attempt to make sense of why this is dragging on.

If the only issue was which assistants were to be retained, I think this would have already been settled. If it's based on what Tuberville's plans for future success with the AU football team are, I also think that would have been settled. Lack of a definitive statement at this point leads me to believe that the possibility of Tuberville being gone is approaching probability and the scenario I am speculating about would help explain what is going on.

Put it this way: This is like a married couple haggling over a divorce. Both want out but one (AU) has veto power in the form of a buyout that keeps the other (Tuberville) from landing in the arms of their (another team) lover.

That was one of the times Tub held Auburn up that he is being paid back for now.

I don't think he wants to coach ... I think he wants a check that Auburn is trying like you know what to avoid paying ... Auburn, on the other hand, is taking its time, following its due process to cover tracks.

Best guess: ends today with a dismissal. AU, having covered its tracks on SAC, loses patience on a negotiated buyout.

If Auburn gets rid of Tuberville, they better come with a top notch hire, IMO.

9:27 AM

Question, and I may have posed this before:

Is it worth a reduced buyout to have a legacy with the program? Photo in the stadium ... name on a building ... welcoming arms from time to time ... other opportunities for love and payment.

The opposite would be getting the full check, and getting your name and reputation pounded at every turn by people who can do it and never let you know it happened.

I dont think CTT wants out. He has too much invested in this program and this community. If that were the case, he would have left last year. I also think he worked too hard last year to get this buyout for him to renegotiate it this year. He is either fired and $6mil richer or he's coaching next year.

9:30 AM
Blogger Unknown said...

I do believe we will see Tuberville back in 2009 with an altered contract. The only way that won't happen is if Tuberville won't agree to the changes and insists he wants his $6 Million. In that case, he is gone.

9:31 AM
Blogger krewe said...

If they were discussing changing a contract in any way shouldn’t Jere Beasley be there? If his contract attorney is not there then it would be reasonable to assume that the contract is not being discussed...or it may be like buying a car and they are sliding a piece of paper back and forth with different amounts written on it.

9:31 AM

AUBigCat, the buyout has been in place sense 2004. Last season they just extended his contract a couple of years.

9:34 AM

AUBigCat, I believe there was some changes in the buyout where the number goes down after next season, but I am not certain. I believe after next season the buyout drops by one million per year.

I agree that this sounds like contract negotiations. If they are arguing the current contract, the lawyer would be there. If they are discussing a new contract, the lawyer wouldn't get involved until there was a tentative agreement.

Blogger AUBigCat said...

It just seems that CTT worked to hard lst year to get the upper hand with this contract buyout to just give it away now. This season is the very reason he negotiated it the way it is, I would think.

9:40 AM
Blogger Unknown said...

They might conference in a lawyer if they are discussing the current contract, assuming there is something to argue.

If they are discussing a potential new contract, they would likely first come up with something that is agreeable to both and then have the lawyers draw up a contract, which will be followed by more arguing.

In terms of contracts, wording is extremely important. In terms of just coming up with a conceptual, this is what we both agree to, it isn't as much so.

You guys obviously made an upgrade but he sure does get alot of grief which is odd condsidering he is a former palyer of UA.

9:42 AM

AUBigCat, the buyout is something that was intended to be beneficial to both Auburn and Tuberville by providing stability to the football program. If we had went undefeated this year, the buyout would benefit Auburn. It works in both directions.

One such case prompted a major automobile manufacturer to recall its unsafe vehicles, while another made a major tractor manufacturer put rollover protection on all of its tractors. Still another prompted a major insurance company to seek out thousands of its policyholders who had been wronged in an effort to correct their policies.

The driving force behind Jere’s success has been his intense commitment to his clients. Jere is, without a doubt, one of the leading trial lawyers in the entire country and a leading advocate for those who have been wronged. He has appeared as a lecturer throughout the country at numerous legal seminars and other events.

He has been profiled in Time Magazine, Business Week, and many other noted publications. Jere has tried over 30 cases that have resulted in verdicts greater than one million dollars, including 15 verdicts that exceeded ten million dollars. He is also featured in the 2003-2004 edition of The Best Lawyers in America, a traditional database of over 16,000 lawyers in 30 specialties, all of whom have been chosen as "the best" by their fellow attorneys.

Jere was co-lead counsel in the record $11.9 billion punitive damages award against ExxonMobil Corp. on behalf of the state of Alabama. The claims by the State of Alabama were based on breach of contract and fraud. Beginning in 1993, Exxon had cheated the State by intentionally underpaying royalties on natural gas from the Mobile Bay field. The future anticipated gain to Exxon, as a direct result of their fraudulent conduct, would have been almost one billion dollars.

My opinion is the only reason Tubs is still here is because of the buyout. I think Tubs would have gladly walked away last year if this buyout wasn't holding him back. The BOT doesn't get along with him and ever since he has been here there has been turmoil. I commend Tubs on the job he has done at Auburn, but I just don't see how a person could be around an Adminstration that doesn't give you true support. I know money may make you overcome things like this but it has to take its toll on you. Would it not be in the best interest for Tubs and University to allow him to seek out other employment without him having to payback AU? Sounds like the perfect divorce to me.
