Quick Note on Eric Smith
Hey everyone. Lee County Sheriff Jay Jones, a friend of the blog, said Auburn tailback Eric Smith surrendered to authorities at 2:40 p.m. today.
He was booked (and soon released on bond) at the Lee County Detention Center on a charge of third-degree assault. That's a Class A misdemeanor. He also has been charged with disorderly conduct, which is a Class C misdemeanor.
His court date is scheduled for Nov. 5.

Let's see...maybe Smith went rescue a female from a belligerent drunk. She just wanted the drunk to go away and didn't want to call the police. Smith showed up and stuff escalated to the point that he had to punch the guy.
I've punched a drunk in that exact situation. That was 30 years ago and men still had a little honor.
I say reserve judgement for the folks that know the entire story.
Sadly, in today's world, you can't go to someone's rescue like that without risking ending up in jail and getting sued.
Chalk it up tp personal injury attorneys and overzealous DAs.

Smith did hit the victim in the back of the head, knocking the victim down and, at least according to police, rendering him unconscious for a moment.
I think this was the culmination of other things that were happening that night. I'm not saying Smith was right to do what he did. I'm just saying the Lexington Hotel that night was hoppin'.
I hope Smith learns his lesson about knocking guys out in front of cops. Man, next time ask them to bring a video camera.

Jay, I just read where the guy said he was struck inside the hotel once, again outside, and a third time that knocked him unconscience. Sounds like the fight started inside and continued outside. I all those blows were from smith, maybe he does need to sit it out a while.
Hit him in the back of the head and then at his car...maybe like trying to get the heck out of there? And Eric was sober? Wow. What's the back story here?
Now this Jenkins dude stated that he was moving towards his car when hit the third time. Could Smith have just been trying to prevent him from driving drunk by knocking him out? Hey, he was helping the guy and may have saved his life. Your honor, my client is a caring individual and couldn't bare to see Mr. Jenkins risk his life, so he prevented it with the only option he saw available. We shouldn't blame Mr. Smith, we should praise him. I rest my case.
It's funny how things happen when alchohol and fists get together. I had a frat brother that loved to fight. He was big too. He kept picking on this other guys at a frat party that was pretty thick. The guy kept sayin he didn't want to fight. Turns out he was a black belt in judo. Last I saw, he was pounding my frat bro's head into the sidewalk repeatedly. Quite a few stitches later, I think my buddy learned his lesson.

Mon....Chivalry can take many forms.....not many of which are present in the young generations. The more physical forms of chivalry (protection) can get you arrested or sued. I'm living at the wrong time in history.

A couple of times I have seen a big guy who was picking on a little guy get the ever lovin crap kicked out of him. It is what I like to refer to as a Kodak moment.

This tells for a good story. Lets just say its about my friend Bill. Last year Bill was drinking underage one night and the cops came to the party and Bill ran to avoid arrest(which is common practice nowadays). Well, unluckily one of the cops suffered an injury while chasing Bill and when Bill was caught, Bill was charged with 3rd degree assault on an police officer. So Bill had to go to court, but Bill got the charge dropped and just got some probation..maybe the same will hold true here.
The biggest sin that I feel that Smith committed so far, is being where he should not have been. What happened after that is speculative at best as of now. Wrong place, wrong time can buy you alot of heartache. Been there, done that one time too many. He should have been an Auburn man as Coach Chizik said earlier. He got his priorities screwed up and it is going to cost him in more ways than one. I am thankful for him that it was not a felony charge.
Jay. You media guys. Always bucking the system...LOL. I'm sure they will work it out. I mean, does anyone buy a paper if not for the sports coverage?

It appears to me that Smith had the opportunity to just walk away or call the cops himself if he were indeed struck first. If I am the Chiz, I lay down the law.

This happened once in my family (dont ask). Person who hit first calls police. Person who got hit declines to sign warrant. Person who hit first does sign warrant, and guess who went to jail? However, when this went before a Judge, person who hit first gets convicted of assault.
There is nothing chivalrous about fighting unfairly, including hiting someone under the influence when you're sober, hitting someone that is not in your weight class, or hitting someone in the back of the head.
At this point, I am willing to watch The Three Daves and return to the old rules. The media coverage has helped turn the SEC into the money machine it is today.

Moral of story: Dont start no s**t, wont be no s**t. Should he have walked away? Yes. But how many of us (especially guys...)are gonna get assaulted and not swing back out of instinct? Testosterone is a powerful drug!

My Tommy I finally answered your email. Sorry it took me forever. I was on a grant deadline this afternoon.
I think theres a lot of information missing from this story. Punching a guy out in front of policeman for a bloody nose acquired earlier in the evening doesnt sound logical to me.
If I could only figure our Michael's code, I could figure out the next Robert Langdon adventure.
I can think of scenarios where a good argument could be made for self defense, especially given the bloody nose. I suspect he's in the Chiz Doghouse for a while, but I dont see a conviction for assault.
Maybe Im just thinking like an attorney. No, Im not, but Ive certainly paid enough of them over the years to have picked up a few things.
I think Eric Smith will probably have a tough time making it to the field this year.

Just playing devils advocate, I guess.
Monica, As always, you are right about what I said and you offered a slightly different perspective on things. Yes, I know the cop being there removes any doubt from what he witnessed until the arrest was made. What I was really talking about being speculative was what happened before the cop arrived. There were several reports given I suspect as always happens in these type cases. Only the judge can sort it out and he will. But the entire event could have and should have been avoided if Mr. Smith had been where he was supposed to have been. The good that will come out of this is the strong message that will be sent to the team and indeed, Mr. Smith will be a better Auburn man or he will be gone. I feel, sadly, that he will probably be gone. I do like moving him to LB as punishment.

I love hearing first person accounts about things Im too young to know about. I met a woman when I first moved to New Orleans who was actually in a concentration camp during WW2. I used to listen to her for hours, just fascinated that what she had actually lived what I can only read about in books.
My 2 cents on Eric Smith.
First off, everyone needs to remember that he is just a young man making a couple of bad choices. He should have a chance to make amends for his actions and pay a debt to his teammates that is acceptable for letting them down. Also, I notice that everyone seems to try and find reason's to justify his actions, but sometimes it's just bad choices on everyone's part and he is guilty of that. The silver lining of this story is that hopefully a precedent has been set for what happens when someone slips up. Hopefully it can be powerful enough to detour other's from making similar decisions. Being on a team that completely lacked discipline, I really value that their are consequences to the actions that hurt the team and the individual. I hope that Eric will learn from this and work his way back onto the team and have a very succesful future off the team and on the team. He does not deserve to be excommunicated from the team and sent to an island to whither away. I truly believe he will get that opportunity to right his wrongs, but he is going to have to earn it.

What do you expect a 'football player' to behave like after someone has punched him in the face (in a fight he didn't start). Do you expect him to run to his mama crying? He's not a figure skater for crying out loud.

I think it will end up being an open and close case. The cop's statement says that Eric Smith had blood coming out of his nose. The other guy started it and opened himself to a can of whupass.

Don't get me wrong, he should be disciplined but I really think that curfew is the larger issue, it shows a continuing lack of judgement vs. an immediate(ish) reaction to getting punched. If we had athletic dorms it would be easier to enforce curfews.
