The lawsuit

Hey everyone. Hola.

Here is my story that appears in today's editions of the Advertiser: SMITH, 2 OTHER AU PLAYERS FACE ASSAULT LAWSUIT

Though my name doesn't appear on the story, which is odd, I promise that I wrote it. Also, I don't believe the other players are facing a lawsuit. They're just described in the lawsuit as aiding and abetting Smith's alleged wrongdoing.

Also, you're welcome to ready through the lawsuit below. I know it's late ... but I try to come through when I promise something to the HOTTIES. Thanks for your patience.

Ok, my two cents.

I work in the insurance industry and I deal with scumbag attorneys all day. This as b.s. as it comes. Eric Smith has no money, what can they sue for? His parents have no money. The law firm of 3 women is looking publicity.

Their website has pictures of them with Joe Namath, Danny Sheridan, Gene Stallings. They go on Finebaum 5 minutes after the suit was filed. MMMM, ladies, lets not be dumb about it.

I did my Auburn deed, I emailed them and gave them a good ass chewing. I feel better now. The defense rests.

I read a lot of legal documents (though, very few civil lawsuits concerning assault), and I find this one way more fun to read. Perhaps it has something to do with the exagerations that make it read like a good children's crime novel.

I've been in a fight or two in my time but never thought about suing anyone. I've been sued before too. Given a choice between the two, I'd rather settle things outside on the playground so to speak.

i've met a couple AU players that i really didn't/still don't like. if we got in a fight and i wanted to ruin him i still wouldn't want the team (my team) to suffer or be distracted from it.

i guess some people have priorities other than football. i feel sorry for those people.

i've been to lots of parties in my life. many at AU. too many some may say. i never had anyone walk up out of nowhere and cause me any trouble. i saw plenty of trouble, but i have never been beaten up by strangers for just hangin'. something tells me mrs. crew has left out many a detail of the prior relationship, if any, these individuals had

all the bammers can go back to sleep. false alarm. the trial is over. yos has been granted. the record is sealed. smith has been suspended for a game and now looks like a doofus again because of the lawsuit. no even much of a news story to me.

i'd be talking what the over-under is on how many yards ingram has in the ib for more interesting conversation.

The wording in the suit is Extremely slanted to favor the plaintiff and to establish a halo over his head Michael. If the truth be known, both were probably equally to blame for the incident.

Been on each end of a beat down in my younger days, but never thought of getting a lawyer - thought a lot about getting even once or twice though.

I am just saying, here we all are as Auburn fans assuming Eric Smith in the absolute best possible light, but it may turn out that he is a total jerk who deserves what he is getting.

I am just saying, let's not assume this Jenkins fellow is a lying jerk, and let's also not assume Eric Smith is the devil. Just let it play out and don't defend/attack anyone vehemently when you have no idea what happened. It is OK to assume, however, that bama lawyers eat their young and shed their skin every 7 months.

You have well stated my position ... time and circumstances will reveal the actions and character of Eric Smith and Decari Jenkins.

What is indisputable is that a suit was filed on Auburn's off week before the Alabama when the statute of limitations for such an action, I believe, is TWO YEARS.

There is only one reason to file such an action in such a time frame -- an attempt to embarrass Auburn's football program.

I cannot be convinced of anything else.

I hate 'em and will for the rest of my days.

I'm no lawyer, nor do I play one on tv, but it sure seems that they'd have had a better chance at a nice payday had they waited until near the end of the Statute of Limitations. Then, they'd be in better position to argue to attach his potential NFL earning. So it's clear to me that FSJ's friends in the REC are up to no good once again.

I'm just sayin'.

Two Questions:

Who the hell was Decari rushing outside to call? His boys?

Why does the fact that Eric Smith a widely known football player entitle Decari to punitive damages? If Mr. Smith was not a widely known football player, is it safe to assume that there would be no punitive damages sought?

I had a friend who got punched at UT by some random dude after talking some trash while drunk. He had to get his jaw wired shut for a couple of months. He sought punitive damages and won.

Just being devil's advocate here. It does seem pretty stupid to put the well known college football player part in the lawsuit, but I don't know that the entire reason there is a lawsuit is because the guy plays football. But that lawyer is totally bammer scum.

There is no reason to sue in this matter unless you are seeking punitive damages.

If this goes to court, compensatory damages would be medical bills ... but that's essentially the money he owes for his care. There's no gravy in that for him and the attorney.

Punitives are what he -- and his attorney -- get to keep.

If this should settle, though, you can bet that all the money that changes hands, though, will be conspicuously labeled as compensatory in the settlement because punitive damages are taxable, while compensatories are not. The attorney gets a percentage of all money collected -- compensatory and/or punitive.

Regarding earlier posts, I'm with Michael and Jet. If this is all proven to be true in a court of law, then ES has to be gone. That said, innocent till proven guilty, etc.

The timing is beyond dubious, however, as well as the hyperbolic nature in which Finebaum released the info.

E-Bro, this is a civil suit. ES's had his day in criminal court on this matter. All of these facts have been heard once already, and the coaches are aware of them. There's no need for him to have further punishment from Chiz and Co for something they've already punished him for.

But I read somewhere last night that an associate athletic director (or something) said that Auburn University was not aware of the new allegations, meaning this isn't what they thought happened back in August.

Either way, even if he's doesn't get kicked off, I'm with michael in what he said earlier Eric Smith being a d'bag if this is all true. I'll give him the benefit of the doubt till anything comes out of this civil case, though.

If Chizik learns something new through the civil case that didn't make it through the criminal case, then that is certainly the grounds for further punishment. It's not like a football coach has to have the law involved when he hands out punishments.

I am sure Eric Smith has his side of the story, and I am guessing his side was good enough for the police not to push this further and for Chizik not to punish him further. We will see how this all pans out.

I dunno. Pretty much reads like the same facts to me. If there are new facts, it's because someone withheld information from the police, which usually does not help out in a civil case. The victim doesn't want his integrity questioned.

I would be willing to bet that someone who wasn't paying attention the first time around asked the asst. AD what his response was to the new allegations. Since there aren't any, his reply of not having heard about the new allegations would be appropriate.

Although I realize there isn't anything else to talk about but aren't we kind of giving the story legs? Maybe if the kid's dad would have come out and said his son deserved what he got this would have died after it happened. What I can't figure out why f bomb and his bammer cronies seem to think this is disaster for Auburn. Eric is a good player but losing him is not the end of the world. It is reasonable to assume that the other two players have already been kicked off the team...and guess what? We made it without them. Does this incident mean Chiz is a poor disciplinarian or poor judge of character? Chiz Senior was a marine that survived Iwo Jima...next question. Does this incident mean the NCAA is gonna pitch a tent at Toomer's? Who cares? We have already self imposed scholly limits without being investigated. The bottom line is there is nothing f bomb nor UAT nor the NCAA can do to take away my degree nor the pride with which it is displayed. They certainly can do nothing to weaken our bond as alumni or diminish our experience while there. We shouldn't give their efforts merit by fretting over them.

And I'm not worried about what implications this case brings. It's only a finebaum caused distraction. It's not anything that will cause grevious harm to Auburn (and I said this last night). It's an isolated incident, unlike a certain campus wide textbook scandal...

I have all the confidence in the world that Chiz does and will do the right thing. That's part of the reason we were down to 74 scholarships, right? B/c Chiz doesn't mess around. I'm just saying Eric Smith might have been kind of a d'bag for doing what he did, but I'm sure he's learned and moved on.

When the OJ trial was going on my roommate in college wrote each attorney requesting an autographed picture...He got one from Shapiro, Bailey, & Cochran.

Cochran's was signed "For Justice, Johnny Cochran"...

after graduating high school a couple buddies & me fly out to L.A. for a week and went to O.J.'s house. this was shortly after the verdict. we got shewed away from his gate by security. it was pretty sweet. ah, to be 18!

I have another OJ story too..

A friend of mine that went to AU was in Miami at a club a few years ago (around 10) and ran into a very drunk OJ...

He had his picture taken with the Juice and right as the picture was snapped he pointed at OJ and made a face like...Can u believe this shat!!!?

Anyway this my friend (whose last name is Simpson btw) didn't tell a single one of us....We only found out when we started receiving Christmas cards with the picture and the greeting "Merry Christmas from the Simpsons."

FSJ - as sort of a follow-on to your autographed picture story; years ago ('83 or '84) Bailey was in the Gump representing some drug dealer who'd been busted after landing his private plane at the Gump airport. I was working part-time for a law firm who had their offices next door to the firm Bailey was using. He came out of the Capital City Club at the same time I came out of our front door so we almost literally ran into each other. I knew he was working in the building so I wasn't surprised. Since I figured I'd never have another opportunity, I introduced myself to him (in much the same way I did with Dr. J this summer). He likely promptly forgot about this meeting but I didn't just so I could share it with you now.

Just one of my many brushes with fame or perhaps infamy.

I finally got around to reading the documents Jay posted. Never knew til now that court documents could be so tabloid-like--very colorful descriptions.

At the end it says "each of the individual defendents." Who are the other defendents?

I hate that this happened, but I do believe that Eric S might have learned from it. One can turn from one's sins. I also hope the Jenkins kid gets over his injuries.

For what it is worth, I am a retired Police Officer. Some things I have noticed from this case:

Anyone can file a lawsuit. And they usually do it for one of three reasons, publicity, money or both.

The Officers originally arrested Eric Smith for Disorderly Conduct, a misdemeanor. Which indicates that at that time, the arresting Officer did not see anything defined as even a low grade Assault (Assault 3rd). Once it became known the "victim" had received physical injury, the Arresting Officer upgraded the charge to Assault 3rd, STILL a misdemeanor (Google the Alabama Criminal Code and you can compare Assault 1st, 2nd, or 3rd with Harassment, which is the actual next step below Assault 3rd and what Eric Smith attempted to charge the "victim" with). While at it, look at the Alabama definition of Disorderly Conduct (the orginal charge against Eric Smith). By the descriptions and accounts in the lawsuit, Smith should have been charged with Assault 1st Degree (a class A felony and one that could give an offender a long time in prison). Keep in mind this is typical lawyering up the case to help their client. The criminal case has been adjudicated. There was obviously not enough physical injury to charge Eric Smith with a felony OR give him any jail time, allowing his youthful offender plea.

In my experience there are three sides to a story. The stories of the two parties and the truth, which is somewhere in the middle. Attorney's do nothing unless there is money of some sort involved in it for them (No Offense to any of you out there). Over time this will become obvious. This case should have been over the day Eric Smith left the court room.

Also good listening is Ricky Williams's conversation with the Dolphins beat guys. Apparently, he hasn't been talking to the media, so they told the front office they'd turn him in and he'd be fined 25k. The way he handled the ensuing interview was hillarious. His answers were short and boring, and he whistled while they asked questions. Apparently, they have never had to deal with access issues like Jay G does, because they were infuriated by it. Ricky Rules.

I want to throw this article in the fray. It really upset me as a man in a fraternity at Auburn.

This is what I love about this article. Around 1/3 of the student population at Auburn is greek. Of that, only a small percentage (I am not going to give an exact estimate) are rude, crude, sexist, and completely drunk at games. I am upset that a lot of the "facts" presented in the article aren't really true. How can you take the worst behavior of a small percentage of the population and present it as the prevalent culture of the University? If you did that will anything, it would be pretty embarrassing. I would love to write an article of the worst behavior of people in New York City and then generalize it to everyone in the city. I am so glad that when I visit in the North East and say that I graduated from Auburn, this is the preconception they will have: I am drunk, stupid, and sexist because of a poorly researched article in one of the most trusted names in newspapers. Thanks WSJ.

I haven't watched it all, but I think it is pretty hilarious. It is obviously ESPN's C-team doing the reporting here. They are reporting on drunk fans with the somberness of a rape story on Dateline.
