Chaz Ramsey sues two former AU employees
Hey everyone. We have some news on the Chaz Ramsey front, albeit from one side of the dispute.Ramsey's lawyer, Steve Heninger of Birmingham, filed a complaint today in federal court (Birmingham) against former Auburn assistant coach Hugh Nall and former trainer Arnold Gamber.
Nall and Gamber left the program soon after Tommy Tuberville's resignation in December.
UPDATE: I spoke with the court clerk in Birmingham and confirmed this information.
UPDATE II: I spoke with Heninger a short time ago. Here are some things he shared with me.
- Ramsey initially injured his back around the time of the 2007 Peach Bowl.
- Ramsey first stuck with therapy. When that didn't work, he had a minimally invasive procedure (hemilaminectomy) to relieve the pain. That was on April 21, 2008. Heninger said Ramsey's doctor had no reservations about the player's ability to return to varsity action after a period of 90 days.
- Heninger said Nall and Gamber began making rigorous physical demands in May.
- Heninger said Ramsey re-injured his back during a workout on June 2, 2008. That injury, Heninger claims, eventually required an invasive surgery that ended Ramsey's football career.
- ``The coaches and Arnold Gamber knew about Chaz's injury. They knew what he could and couldn't do. They ignored that and forced Chaz to participate in exercises that ultimately cost him his career."
- Ramsey's orthopedist was Stanley Faulkner of St. Vincent's East in Birmingham. Ramsey was referred to Faulkner by Mike Goodlett, Auburn's team physician.
- NEW @ 4:10 p.m. On June 3, 2008, Goodlett made a note on Ramsey's medical chart that said: ``My extreme displeasure over the fact that Chaz was allowed to do weight-room activities on 6/2/08 was voiced at length to Arnold Gamber ..."
- NEW @ 4:15 p.m. Once Faulkner intervened and demanded that all weightlifting activity stop immediately (on 8/28/08), the complaint alleges, Ramsey was "humiliated and had his manhood called into question by his offensive line coach, Hugh Nall. A systematic pursuit was undertaken to embarrass and harass (Ramsey) because of his refusal to engage in drills ..."
- NEW @ 4:25 p.m. Ramsey underwent a second procedure, this one more invasive, on Jan. 21, 2009. That day, Goodlett petitioned the Southeastern Conference to grant Ramsey a (lifetime) medical exemption. A portion read: ``It is our fear that that continued participation in intercollegiate football would lead to further surgery and and possible long-term sequelae."
- NEW @ 4:35 p.m.
Here are the six accusations ("counts") made:- Negligence. Ramsey believes Gamber and Nall's actions put him at increased risk for re-injury, which occurred. Ramsey asserts that both men acted beyond their scope of authority by forcing him to prematurely engage in rigorous drills.
- Wantonness. Similar to the negligence claim.
- Interference with the physician/patient relationship. Alleges that Gamber/Nall "acted intentionally in bad faith, willfully, maliciously and beyond the scope of their individual and collective authority" to undermine Faulkner's orders.
- Outrageous conduct. Alleges that Gamber/Nall "committed outrageous conduct by intentionally inflicting severe emotional distress upon (Ramsey)."
- Civil conspiracy. Alleges that Gamber/Nall cooperated ``with each other and with others in the Auburn football program yet unknown to embark on the course of tortious and injurious conduct."
- Violation of civil rights. Alleges that Gamber/Nall violated Ramsey's right to "health, well-being and pursuit of happiness" by interfering with Faulkner's prescribed course of action.
- Negligence. Ramsey believes Gamber and Nall's actions put him at increased risk for re-injury, which occurred. Ramsey asserts that both men acted beyond their scope of authority by forcing him to prematurely engage in rigorous drills.
- Here are some things Heninger said on WJOX's "The Roundtable" show:
- On why Auburn cannot be sued: ``They have sovereign immunity. Any state institute cannot be sued for negligence or gross negligence or anything like that. You can sue an agent or employee of the state if that agent acts beyond the scope of his actual authority. When you have restrictions, you can't go beyond that authority and do what you think should be done."
- Heninger said Ramsey was ``intimidated" into doing weight drills and line drills: ``The phrase `man up' was used a lot."
- ``(Nall) got the team together and told them: `Stay away from Chaz Ramsey. He's not a man.' His locker was cleaned out. His meal ticket was taken. They did everything they could to intimidate him."
- Heninger expects this case to go to trial next summer.
- Heninger believes Auburn's lawyers will play a role in defending Gamber and Nall, which will create the illusion that Auburn is involved: ``It's really not."
- In the interim, he's planning to take depositions from a lot of people involved in the Tigers' program: ``I've got to take a deposition from Coach Tuberville and a lot of assistant coaches to find out: How high did the orders come down from? From the evidence I've seen, it's Hugh Nall and Gamber.

At least it seems they are going after specific people who impacted the situation and not just a blanket "sue everyone" kind of thing.
Don't be fooled, Cincy. If they could, they would. That's how they do it, throw the net out and see who they can get.
Maybe it's good Auburn cleaned house when it did. If this proves to be true, I really hate it for Chaz. No game is worth this kind of stuff.

Hoopie, when you are in a situation like that, you can't really have it your way. He was part of the team, and on scholarship. Players are supposed to trust the trainers and do as they are told.

It's very unfortunate for Chaz for it to end up this way.
If the allegations are true, you are right Hoopie. It is about personal responsibility; as in if you are in a position of authority, you must be held accountable for what you order the people under your care to do. Don't worry, Chaz will be paying for his inability to stand up to Nall for the rest of his life. If Nall and the trainer pressured him to go against doctor's orders, then they should take responsibility for that action.
You can't say "be a man" when the power differential in a relationship is such that even speaking up in a reasonable manner can cost you your future.

By the way, I am sure Nall and company have their side of the story. Maybe Ramsey didn't tell them the extent of the injury for whatever reason, or maybe Ramsey set all this up after he already new he had a substantial career injury previous to this "re-injuring due to working out." We'll see how it all ends up. Everyone here is innocent until proven guilty.
First of all, Nall's alledged actions are inexcusable. I understand team unity and all that, but sometimes ya gotta think for yourself. The surgeon and team doctor told him not to do the workouts and he caved in to the coach?
I know a pitcher that told his HS coach that he wouldn't pitch even though ordered by the coach. That kid got a very nice pro signing bonus and pitches in the minor leagues b/c he preserved his arm.

Without expressing my opinion, I guess I am surprised that Tuberville wasn't sued as well. If this case gets trial, it will be the biggest upset since we blocked two punts.
Hopefull Nall has malcoaching insurance. I assume he got some after that 2003 season, am I right?!

I may be alone in this, but I always thought that Nall was a dirtbag. Never have been a fan. And as a veteran of the transportation industry, I can assure you that Nall has found his niche in life now.

I second the notion that Nall fits right in with his new company.

The pressure from college coaches is very powerful. Let me just say from personal experience that an injury suffered while playing at the college level was not fun to deal with. Coaches want you on the field at any cost.

Good lawyering. Civil rights violation charge is the access to federal court. Interruption of doctor-patient gets you to Birmingham's northern district rather than Montgomery's middle district. Otherwise, this is a state court case in Lee County.

Last time I checked, Ramsey was never imprisoned and tortured. He never lost his rights.
Look, I agree Nall and Gamber should be held responsible for their actions, and I know these claims are really starting points for negotiations, it just bothers me a little. That's all.
The civil-rights claim is a tool.
The negligence and the wanton stuff are the important elements here.
There is no statute that says "you can't shame a guy into playing football even though his doctor's say to do so will risk further injury."
There are statutes that say you can't wantonly endanger a citizen, etc. Ramsey alleges a wrong was done and he has to fit his allegation to the law.
W/o the civil rights claim, it's a bad venue for Chaz. If I were defending, I'd try like crazy to say this is a state court case that belongs in Lee County.
Some past WR should sue Greg Knox for screwing up his ability to correctly run routes or to actually be able to run routes.

Sincere congrats on the AP vote BTW. That's well deserved recognition in your industry.
Ramsey may have been legally an adult but he'd spent most of his life under the authority of coaches. It's an unusual kid that can go against that authority.
If the allegations are true, then Nall and the trainer abused their authority and they are responsible for the consequences.
I don't think Tuberville is in the clear yet. If they find any connection during discovery, they'll go after him too. After all, his are the deep pockets.
I have a hard time believing Tuberville, knowing the guy he is and how involved he was with the conditioning aspect of football, called a Santiago-style CODE RED.
I'm not saying he did, and they obviously have nothing to show it now or he'd have been named.
I'm just saying the lawyers would go for him if they can uncover a connection and they'll be trying to.
Tuberville seems more like Markinson than Jessup.

I wonder what Marcus McNeil thinks about this case, since he had a severe back injury while playing at Auburn. I worked for of the toughest OL coaches that Auburn has probably had in Trickett and I can promise you that would not have happened. I just don't think much of Nall. Never have and never will. Good RB play made him look better thanhr should have. I side with Chaz in this mess, but I wonder if it will even go to court. It is Auburn after all, cases usally get settled before then.
Good point Eddie, it does make you wonder about Marcus McNeil, King Dunlap and other OL that had back problems while they were at Auburn.
I think as in most cases there is some blame that should fall on both sides.
No way this goes to court, right?
I would bet good money this gets resolved without much fanfare and no court at all.
The odds of this going to court is about as good as Auburn winning the national championship this year.

Think about it, you have the team doctor Goodlett going against former trainer Gambler. It could get ugly and it will affect the perception of Auburn. When the Founding Fathers wrote the Bill of Rights, I really don't believe they envisioned "freedom of the press" to encompass pre-season rankings and pre-season All-this and All-that teams. It's one of the stupidest things ever put on paper.

I think they voted it down. Bear arms are too hairy and unattractive.
Speaking of bear arms....I was at a local DOT engineering office today and noticed that every man in the building was wearing a short sleeve dress shirt. If I remember correctly Omnica considers that attire to be unattractive. I've noticed that I get a lot more cooperation from said engineers if I dress similar to them.

I'm ugly and I know it. So short sleeve dress shirts don't really have as much detrimental impact on me as they would on Brad Pitt, or on DL. Besides, they keep me from having a heat stroke in some of the sauna-like offices I work in. (I also wear a hooded sweatshirt at a few meat locker offices)

My father-in-law was a very high profile executive for a large corporation - he wore short sleeve dress shirts and clip-on ties - didn't seem to hurt his career at all!

Jet-FWI: No tropical storm in the Gump today. Warnings were sent out but unfortunately the winds shifted and did not make this far down.

Cincy....I am a chameleon dresser. On any particular day, I could be found anywhere from "in a ditch with laborers" wearing shorts and boots to donning a suit and presenting a rezoning application before a metropolitan county commission hearing.
Those State employed Department of Transportation engineers are a very predictable breed. I've noticed that I am received well and get quicker results if dressed like them.

When we first married hubby worked for a large paper company. I was so proud of my college graduate engineer and "dressed" him up for work everyday in a starched dress shirt and tie. His boss sent a note home to me saying unless I wanted his head pulled off by catching his tie in a paper machine to lose the shirt and tie. I quit dressing him after that.
Phred....Michael is a complex fellow. He has that fear/hatred of puppets thing to deal with, coupled with the stress of running his multiple sheep and goat ranches.
Hint: don't ask him 'bout his bidness.
Cincy...my first work experience was sortof the opposite. I interviewed and was hired by one of the largest Atl general contractors. After we had agreed to the employment details, the owner of the company looked at my raggedy college blazer and offered a $1,000 signing bonus to go buy suits, pinpoint oxford shirts and silk ties. He also pointed out that all office men wear starched shirts. Not your normal construction company, but I took the deal.
Guess it is time to call it a day. Perhaps tomorrow will bring good news of Auburn football. Can't wait to see who THT chooses for the day.
Plus, tomorrow my son-in-law hopes to get an offer from the law firm he has been interning with during the summer. Wishing that comes through cause that means they will move to Birmingham in 2 years - after his last year of law school and a year of clerking for judge in Montgomery. I so hope they come to B'ham!!

Just got in and read the Ramsey update. Jay, thanks for the information. I come here to read and discuss ALL Auburn news, whether it be good or bad. As for Ramsey standing up to Nall, a college coach has so much control of a players' future, I see no way he could have done so without fear of what might happen to his career.

Honorable mention today to center Tom Banks and DT Mike Pelton, each of whom achieved ALL-SEC postseason honors.
But today's honoree was an ALL-AMERICAN as a junior and again as a senior. He was one of the best SEC centers ever, played on the 1957 national champion team, captained the 1959 team, and in his spare time played basketball and baseball at Auburn. Following his college years, he was a 1st round NFL draft choice of the Baltimore Colts. He went on to a long NFL career with the Colts, Saints, and Cowboys.

Thank you RK for mentioning my good friend Rick Neal. He was one of the most under-rated LB's to play at Auburn, especially when you line up next to Takeo Spikes, but Rick played with everything he had.
After the Chaz lawsuit, I've decided that we Auburn Fans should sue Tubs for holding us hostage at gun point and stealing our money while he was duck hunting in Arkansas.
But Eddie, Tub went huting in Arkansas every December. There was nothing else going on, I don't see why you are making a big deal about it.
I'd still love to know how close he was to taking the Arkansas job during that time.

RK- Who knows, but everytime his named started floating around for jobs, I could feel a mugging coming on.
Eddie, I always assumed it was Sexton and Tub playing games to get more money until last year when that station out of Arkansas announced Tub as the new coach.
At that time I felt we should have just cut ties and hired Petrino. It might have saved us a huge headache last year.
I have no desire to be loved and left by Bobby Petrino.
I think Petrino is at the point that he knows he has to show some loyalty.
Until Chizik proves he's worth the risk, Petrino would have been a far better option and with him we would have been better than 5-7 last year.
I just wish I had the golden parachute that Tubs had so that I could say F it, quit trying to work and wait for them to fire me. I hate Sexton. He is the master of this crap, just look what he got Nutt last year.
Never say never, but I would have an extremely hard time supporting Auburn if Bobby Petrino was our coach - I would, but I surely wouldn't like it. I think he is a snake.
Cincy- I thought I was gong to have a hard time supporting Auburn when Chizik was named, but i've quickly changed my stance.
Cincy, I agree, but fortunately, we don't have to worry about that (for now anyway).
I wouldn't say Tub quit trying to work, but I do think the effort wasn't the same starting around 06 or so.
I really hope Chizik does well as a HC, but I do have my concerns that in 2 or 3 years we'll be debating if it's time to give Gus Malzhan or Trooper Taylor their 1st HC job.

I didn't know enough about Chizik to not like him as a hire. But, when tfaced with the potential of hiring Petrino, Nutt or Leach, Chizik seemed like a fine choice. Those other three give me the willies.
